A repeat offender is accused of a level 1 drug misdemeanour if caught with at least 24 plants. They can be penalized by being sent to county jail for 6-18 months and are required to pay a fine of up to $5000.
A subsequent offender who has more than 24 plants will be charged with a class 3 drug felony with between 2-4 years in a state institute with a fine of between $2000 and $500,000.
A person is liable for being sent to jail for 4-6 years if they have more than 24 marijuana plants in possession while on parole or probation. They can also be charged if they are felons or escaped from any of the prisons.
